STORAGE TERMS & CONDITIONS
(w.e.f.  1st JANUARY 2004)

( SUBJECT TO MUMBAI’S JURISDICTION ) 

1.           We accept your materials sent for storage in our Godowns, subject to our own storage Trade Terms and Conditions printed underneath. Our Trade Terms & Conditions & Storage Rate List may be changed at any time without prior notice, which will supercede all our previous Trade Terms & Conditions & storage Rate List.

2.           We don't check and verify package’s contents, quality and weight. They are believed to be so as per your storage documents submitted to our Godown-in-Charge at the time of your delivery by your transporter/s.

3.           We don't take any “General Insurance” Policy covering all risks safety of your materials stored in our Godowns. You will have to take “All Risks General Insurance” Policy at maximum premium rate for all natural calamities including riot, Burglary, Theft & handling damage covering our whole warehousing complex in general as to safeguard your total stored material’s risk as to avoid refusal of your legal claim by insurance company. You are requested to consult us before you go for general insurance policy. Xerox copy of your general insurance policy should be sent to us for our records.

4.           We accept your materials for storage at your entire risk and store them where storage space is available in our whole General warehousing complex. We don't accept damaged or leaking materials for storage. However, if requested, the damaged materials and leaking materials will be stored at your entire risk and result.  In that case no claim of any kind in respect of your damaged and leaking materials loss will be entertained by us.

5.           We will not accept your materials for re-storage once delivered and brought back to our Godown for whatsoever reason. However, it will be re-stored on your request as fresh receipts without our responsibility of any kind.

6.           We will not be held responsible for effects of weather, Heat, Cold, Moisture, Dryness, Pests, Insects, Rates and Rain etc. during storage of your materials in our Godowns.  Chemical reactions & affections, Quality change by unknown reason and un-noticed internal leakages of individual lots staked near your materials during storage, we will not be held responsible for un-noticed leakage and loss of your materials during storage of your lot kept for long period.

7.           We will not accept any legal liability of your materials stored in our Godown. You will have to fulfill all legal requirements by relevant documents to the concerned legal authorities. We will not accept any Bank formality or liability without our knowledge in advance.

8.           Temporary Storage Receipts and instant acknowledgements of materials received in our Godowns by any of our Godown-in-charge or by any of our office-Assistant whether on lorry receipts (LR), delivery challans or storage letters will not be a legal claim. You will have to obtain our official Goods Storage Receipts duly signed by our authorized agent against all abovesaid acknowledgments you have collected from our Godown-In-Charge & office staff member.

9.           Acknowledged storage documents will not be delivered to your office. You will have to collect your documents from our office or from our Godowns. Urgent documents delivery services will be given in exceptional case at your cost and consequence where we will not be held responsible for loss of your documents in transit by carrier.

10.       We will not entertain your materials claim if it is supported by our original Goods Storage Receipt of more than one year unless it is recontinued by any of our authorised signatory who has signed on it for further period.

11.       We will not be held responsible for any legal responsibilities for goods stored in our Godowns allotted to you on lumpsum fixed storage monthly charge-basis.

12.       Fixed area storage charge will be on Measurement basis calculated on super Built-up area.

13.       Three-months storage charge as interest free Security Deposit and one month Storage Charge advance payment will be compulsory for fixed area storage arrangement.

14.       We should be informed in advance about your selection of monthly/weekly/daily storage charge-option shown in our current rate list before you store your materials in our Godowns or atleast on the first day of the storage.  In case of your failure to inform us about your selected storage option, you will be charged at our usual monthly storage rate as per our current rate list.

15.       We will charge you as per our current storage rate list for your usual cargos and consignments. Uneven cargoes will be charged on the basis of actual space occupied by the individual packages and stakbility of the particular packages.

16.       We expect our storage charge Bills’ payment within 15 days from the date of our Bills. Failure of payments of three continued storage periods' bills will be resulted in disposal of your materials at available market rates without your notice and the proceeds of the disposal of materials will be credited to your outstanding account. Interest @ 18% will be charged on your total outstandings in case of your payment default.

17.       We will not allow you to lift your balance materials unless our total outstanding upto the date of last delivery is settled in full.

18.       Unloading and loading of your materials will be done by our own engaged labours at our own current labour rate list. Labour rates list is always revised in every November as per Maharashtra Govt. declaration in every October. The Percentage difference of rise in dearness allowance will be added to the labour rate list prevailing at that time.  Manual unloading and loading will be charged per metric tonne. Fraction of tonne will be charged as full tonne.

19.       Forklift and Crane handled materials unloading and loading will be charged on the basis of actual working hours of the forklift or crane for particular consignment at the rate prevailing in Andheri / Bhiwandi area.

20.       We will not be held responsible for handling damages of your materials while Warning (Warai), Unloading and Loading by laboures at the time of the receipt or delivery. Handling damages or loss of your materials during labour operations will not be compensated.

21.       We will not deliver your material without your valid delivery Order issued by your company's authorized person. Delivery will not be effected on corrected delivery order except it is signed by the original signatory of that Particular original D.O.

22.       We will not compensate wrong deliveries, Non-Deliveries and detained deliveries of your materials for whatsoever reasons beyond our control. Also, we will not be held responsible for wrongly collected materials by your self or by your clients & supplied to your/their customers from our Godowns and used without prior sample checking of the collected materials. Transport charges will be paid for replacement of wrong deliveries by our Godown-in-Charge.

23.       We will accept and deliver the goods only on working days between 10.00 a.m. to 6.00 p.m. You will have to pay for late hours /Sunday/holiday receipts & deliveries of your materials as per our system. No delivery on Sunday or Holiday.  You are requested to collect our holidays list from our Godowns or Office for your movements convenience.

24.       Deliveries except working days or late hour deliveries will be accounted as next working day deliveries and will be charged accordingly.

25.       We will not be held responsible for non-delivery of your materials on account of legal suspension of routine work by our labours, labours strike, bundh, riot and social disturbance problem beyond our control.

26.       Your are requested to send us your stock statement in case of any discrepancy to find out the mistake from our stock ledger.

27.       Your Co-operation for our above said storage Terms & Conditions will encourage us to serve you better as your trusted warehouser.  All disputes should be settled amicably to avoid legal formalities.
